HISTORICAL DEVELOPMENT OF THE MODELS FOR CROSS-BORDER INSOLVENCY REGULATION IN EUROPE

Cross-border insolvency within Europe has proven to be difficult for regulation. Several decades were needed in order to enact a Regulation on the topic. One of the most controversial matters was what model to be chosen for the regulation of cross-border insolvencies. The aim of this article is to analyse the historical development of these models up to the present moment and to outline their advantages and disadvantages.
